Terms of Use

 

These Terms of Use (hereinafter referred to as the "Terms of Use") defines the membership registration for the online store (hereinafter referred to as the "Service") provided by CHAHO　YUTOHA (Hasegawa Co. Ltd., the operator, hereinafter referred to as the "Company") on this website and the contents of the membership service. Registered user (hereinafter referred to as the "User") shall be bound by these Terms of Use to use the Service in accordance with these Terms of Use.

Article 1 (Application)

The Terms of Use shall apply to all relationships related to the use of the Service between the User and the Company.


Article 2 (Registration)

Registration shall be completed upon registration application by the applicant in accordance with Company's specified method.

 

Article 3 (User ID and Password Management)

  1. The User shall manage their user ID and password for the Service at their own responsibility.
  2. Under no circumstances may the User transfer or lend their user IDs and passwords to any third party. The Company shall deem any login with a user ID and password combination that matches the registered information as use by the user who registered the user ID.

 

Article 4 (Prohibitions)

  1. The User shall not engage in any of the following acts when using the Service

(1) Acts that violate laws and regulations or public order and morals

(2) Criminal acts

(3) Any other acts that the Company deems inappropriate

 

Article 5 (Suspension of the Service, etc.)

  1. The Company may suspend or discontinue the Service, in whole or in part, without prior notice to the User, in the event that the Company determines any of the following events to have occurred.

(1) When performing maintenance or updating computer systems related to the Service

(2) In any other case the Company deems it difficult to provide the Service

  1. The Company shall not be liable for any disadvantage or damage incurred by User or third parties as a result of the suspension or interruption of the Service, for any reason whatsoever.


Article 6 (Use Restrictions and Termination of Registration)

  1. The Company may, without prior notice, restrict the use of all or part of the Service or terminate the registration of the User in any of the following events

(1) Violation of any of the provisions of the Terms of Use

(2) In any other case the Company deems the use of the Service to be inappropriate

  1. The Company shall not be liable for any damages to the User resulting from the Company's actions in accordance with this Article.

 

Article 7 (Disclaimer)

  1. The Company shall be exempted from liability for default if such default was not caused by the Company's willful misconduct or gross negligence.
  2. The Company shall be liable for compensation only to the extent of damages that could ordinarily arise and to the extent of the amount paid, in the event that the Company is liable for any reason.
  3. The Company shall not be liable for any transaction, communication, or dispute between User and another User or a third party in connection with the Service.



Article 8 (Change of Service Contents, etc.)

The Company may change the contents of the Service or terminate provision of the Service without prior notice to the User, and shall not be liable for any damages incurred by the User as a result of such changes or termination.

Article 9 (Modification of Terms of Use)

The Company may change the Terms of Use at any time without notice to the User, as the Company deems necessary.

Article 10 (Notification or Communication)

Notices or communications between the User and the Company shall be made in a manner determined by the Company.

  

Article 11 (Non-assignment of Rights and Obligations)

The User may not assign its rights or obligations under the Terms of Use to any third party or offer them as security without the prior written consent of the Company.
